Bittools Terms of Use

The user must be fully responsible for the confidential treatment and proper custody of the passwords available to them for access to the platform, preventing unauthorised third parties from accessing them. In any case, a licence for use or exploitation is linked to a company and to an IP address. The administrator of this licence of use may enable and manage \"agent\" licences, for which the agents' first name(s), surname(s) and ID number will be collected in order to monitor the use they make of the application and their material responsibility for each of the actions carried out.
The information provided through this platform has been obtained from the telephone operators themselves as a result of the corresponding authorisation for the preparation of electronic and online telephone directories.
The information provided on this platform is strictly adapted to Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and to Organic Law 3/2018 of 5 December (LOPDGDD).
If the telephone numbers obtained from this platform are to be used for commercial purposes in the field of consumers and users, the user must also take into account the limitations established in the General Law for the Defence of Consumers and Users.
Through this platform, Bitmon provides agile and convenient access to the raw information supplied by the operators without altering it, using up-to-date versions thereof. Nevertheless, it may happen that certain updates have not been communicated to us, and therefore Bitmon cannot be held 100% responsible for the accuracy or updating of the information provided through the platform.
Bittools cannot guarantee that the use made of the platform and its services will always comply with the law, these general conditions, morality and public order; however, it will adopt the necessary measures laid down by law to ensure compliance with current legislation.
In any case, Bitmon shall not be liable for any damages or losses of any kind that may arise from the incorrect, unlawful or improper use made by the user of the platform or of the services and contents offered. In this regard, Bitmon shall not be liable for the use of the platform by minors, and the download and use of the platform shall be the sole responsibility of the user.
The user must, in each commercial or advertising action they carry out, take into account the latest update of the opt-out lists provided by Bitmon through the platform. The colour indicator that appears to the right of the contacts shows their status:
- Orange: They do not wish to receive commercial communications.
Therefore, the user must observe and respect this status when sending their commercial communications.
The \"My contacts\" section consists of a personal space for the user where they can add, save and manage those contacts of greatest interest to them. Likewise, this section is also updated in accordance with the Robinson List and the updates periodically notified by the telephone operators. In addition, within each of the contacts there is a form that can be completed with information on negotiations and the data subject's consent. As regards GDPR requests, a field is enabled from which the user may manage this type of request. The user shall be solely responsible for the actions they carry out within this personal area of the application.
From the \"My contacts\" section, the user may make one-off downloads of up to 100 contacts. Each of these downloads will include the following data: date, IP address and the agent who performs the download.
In order to prevent massive use through automated or robotic processes of the application, queries are limited to 200 lists per day.
It is strictly forbidden to carry out mass downloads through automated or robotic processes, and Bitmon reserves the right to report this to the authorities and to take the appropriate legal action.
With regard to users who act as franchisors, they guarantee that both they and their franchisees will comply with the provisions of the applicable data protection regulations and with these terms of use.
Bitmon shall be exempt from any type of liability arising from the information published on the platform, provided that such information has been manipulated or entered by a third party outside it.
Bitmon reserves the right to prevent the user from accessing and using the services of its platform at any time and without prior notice in the event of non-payment, breach of the agreed general and specific conditions of use and in the event of acts contrary to the law, morality, generally accepted good customs and public order.
Under no circumstances shall the provider be liable for moral damages, loss of profit and/or any direct or indirect damages that the user may suffer as a result of the use of the platform and the data provided therein.
Bitmon shall not be responsible for the use made by the user of all the records downloaded from the platform once the contractual relationship between the parties has ended and the right to use the telephone directory has expired. In this respect, the validity period is 1 month from the time the records are downloaded.
This platform has been reviewed and tested to ensure that it functions correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. Nevertheless, the provider does not rule out the possibility that circumstances may arise, such as programming errors, service interruptions to carry out maintenance tasks or events beyond its control, such as force majeure, natural disasters, actions by hackers or crackers, strikes or similar circumstances that make access to the platform's website impossible.
Therefore, Bitmon shall not be liable for any loss or damage that may occur in relation to the downloading or use of the platform, such as that caused as a result of failures, breakdowns or interruptions in the operation of the platform (for example, and without limitation, errors in communication lines, defects in the platform's hardware or software or failures in the Internet network). In any event, the user may not claim any financial compensation for such interruption of service.
The platform, including, by way of example but not limited to, its programming, editing, compilation and other elements necessary for its operation, as well as the designs, logos, text and/or graphics, is the property of Bitmon or, where applicable, is used under licence or with the express authorisation of the authors. All the contents of the platform are duly protected by the regulations on intellectual and industrial property and are registered in the corresponding public registers.
Regardless of the purpose for which they are intended, the total or partial reproduction, use, exploitation, distribution and commercialisation of the contents require in all cases the prior written authorisation of Bitmon. Any use not previously authorised by Bitmon shall be considered a serious infringement of the author's intellectual or industrial property rights.
Designs, logos, text and/or graphics not belonging to Bitmon and which may appear on the website belong to their respective owners, who are themselves responsible for any possible dispute that may arise in relation to them. Bitmon expressly recognises in favour of the holders the corresponding intellectual and industrial property rights, and their mere mention or appearance on the website does not imply the existence of any rights or any responsibility for them, nor any endorsement, sponsorship or recommendation by Bitmon.
Bitmon reserves the right to modify this legal notice at any time, while respecting the rights acquired by users. Any modification will be notified to users as soon as possible. Use of the website / platform, or acceptance of the corresponding terms of use after the modification, implies acceptance thereof by the user.
Furthermore, Bitmon also reserves the right to edit, update, modify, suspend, delete or terminate the services offered by the platform, including all or part of its content, without prior notice, as well as to modify the way in which it is accessed.
Possible grounds for modification may arise for reasons such as adapting to possible legislative developments and changes in the platform itself, as well as those that may derive from the existing sectoral codes or for strategic or corporate reasons.
The law applicable in the event of a dispute or disagreement regarding the interpretation of the terms of the legal texts, as well as any issue relating to the services of this website, shall be Spanish law.
